By checking the box directly beside the “I have read and agree…”clause that links directly to this page, the User agrees to:

1.  Engage OFWParaSaPamilya.com (the “Company”) as his/her representative to set an appointment or arrange follow-up care with one of the doctors (Medical Providers) mentioned in the Company website, who, in the best professional opinion of the website Medical Coordinators, has the specialization and skills to treat the symptoms described by the User.

2.  Instruct and advise the User’s patient-relative to proceed to the place and time for the appointments where the Company representative will meet and assist the patient.

3.  Authorize the Medical Providers to fill out the Company Report form and provide, thru the Company, for submittal to the User, the findings and any follow-up care required, including an estimate of the Medical Provider’s fees, laboratory test fees and other expenses for the initial or follow-up care.

4.  Pay the indicated fees for the initial appointment and any outpatient follow-up care, after which the Company will confirm the time and place of the appointment.
--For hospitalizations: a) Pay 30% of the estimated cost to enable the Company to confirm admittance date and other hospital requirements; b) make other progress payments required by the hospital, within 2 days, from the time when the Company informs the User of these hospital requirements; c) pay in full the balance of all hospital and related fees two days prior to the scheduled date of discharge from the hospital.

5.  Acknowledge and agree that the Company will earn and keep as payment for its services: Philippine Pesos 250.00 (from the PhP 850.00 paid by the User for initial consultation); and 9 (Nine)% of the lead Medical Provider’s fees for follow-up care.  All other expenses for laboratory tests, hospitalization, medicine and the like will be billed at cost to the User without any fee paid to the Medical Provider or the Company.

6.  Confirm that the Company and Medical Provider are independent contractors with separate and full responsibility for their respective actions under this Agreement.  User further agrees to hold Company, as its agent, free and harmless of all losses, claims, demands, liabilities, actions, costs and expenses including legal fess, arising out of or in connection with any action or procedures, tests, medical, cosmetic or other treatments undertaken or recommended by the Medical Provider for the User’s patient.

7.  Interpret and construe this agreement under the laws of the Philippines, where the services, requested by the User, will be rendered.  User and Company agree to settle all disagreements amicably between themselves, failing which they will refer the dispute to arbitration, in accordance with the then in-force domestic commercial arbitration rules of the Philippine Dispute Resolution Center, Inc.

As payor for the patient, the User further confirms and warrants that the patient agrees to all the terms and conditions stated above.
